Competition Terms & Conditions: “Black Cygnet Hamper”
1. Promoter Details
1.1 This promotional competition (“Competition”) is organised and conducted by Keveko (Pty) Ltd (“Keveko”) together with Black Cygnet Life (Pty) Ltd (“BCL”) (collectively referred to as the “Promoters”).
1.2 The Competition is conducted in accordance with the provisions of the Consumer Protection Act 68 of 2008 (“CPA”).
1.3 A copy of these Terms and Conditions is available at no cost for the duration of the Competition and can be requested from Keveko.
2. Competition Period
2.1 The Competition commences on [INSERT START DATE] and will operate for an initial fixed period of 3 (three) months (“Initial Period”), during which the rolling draw mechanism set out in these Terms and Conditions shall apply.
2.2 During the Initial Period, the Competition will operate on a continuous rolling basis, whereby a winner is selected for every 250 (two hundred and fifty) qualified participants who successfully complete their meetings in accordance with these Terms and Conditions.
2.3 Upon expiry of the Initial Period, the Promoters may, at their sole discretion:
2.3.1 continue the Competition on a rolling basis under the same or amended mechanics; or
2.3.2 suspend or terminate the Competition; or
2.3.3 extend the Competition for defined additional periods.
2.4 The Competition shall continue beyond the Initial Period only if expressly confirmed by the Promoters on the official Competition landing page or via direct communication channels.
2.5 The rolling draw mechanism shall operate in sequential cycles of 250 (two hundred and fifty) qualified entries throughout the Initial Period and any subsequent extension periods.
2.6 The Promoters reserve the right to terminate the Competition at any time by providing notice on the official Competition landing page or via direct communication channels.
2.7 Any entries received after termination of the Competition shall not be valid.
3. Eligibility
3.1 The Competition is open to active Black Cygnet bond protection customers who have held an active policy for a minimum of 6 (six) consecutive months at the time of entry.
3.2 Participants must be natural persons, South African citizens or permanent residents, and aged 18 years or older at the time of entry.
3.3 Employees, directors, agents, contractors, consultants, and immediate family members of Keveko, Black Cygnet, their associated companies, agencies, or affiliates are excluded from participating.
3.4 Participation in the Competition is free and no purchase of any product or service is required to enter, other than compliance with the entry requirements set out below.
4. The Prize
4.1 The prize consists of payment of the winner’s primary residential mortgage (“bond”) instalment for 1 (one) month.
4.2 The prize is capped at a maximum value of R15,000 (fifteen thousand rand). Any amount exceeding this cap shall remain the responsibility of the winner.
4.3 The prize amount shall be limited to the winner’s standard contractual monthly bond instalment and shall exclude any arrears, penalties, legal costs, insurance premiums, or ancillary charges.
4.4 Where operationally possible, payment of the prize will be made directly to the relevant financial institution against the winner’s mortgage account. Where this is not reasonably possible, the Promoters reserve the right to make payment directly to the verified winner.
4.5 The prize is non-transferable and may not be exchanged for cash, credit, or any other product or service.
4.6 The Promoters reserve the right to substitute the prize with an alternative prize or cash equivalent of equal or lesser value should circumstances beyond their control prevent fulfilment of the original prize.
4.7 Any tax liability arising from acceptance or use of the prize shall remain the sole responsibility of the winner.
5. Entry Requirements
To qualify for entry into the draw, participants must:
5.1 Successfully book a meeting with a Keveko Financial Planner via the official booking link provided on the Competition landing page or authorised communication channels.
5.2 Attend the scheduled meeting in full.
5.3 Failure to attend the meeting, repeated cancellations, or prematurely ending the meeting may result in disqualification of the entry.
5.4 Only one entry per participant shall be permitted per draw cycle.
5.5 Attendance at the meeting does not create any obligation on the participant to purchase any financial product or service.
6. Selection Mechanism (The “250 Rule”)
6.1 One winner shall be selected for every 250 (two hundred and fifty) qualified participants who successfully complete their meetings.
6.2 The draw shall take place within 7 (seven) business days of the 250th qualified entry being recorded.
6.3 Winners shall be selected through a random electronic draw process conducted in a fair and transparent manner.
6.4 The draw process shall be overseen by an independent party, compliance officer, or designated representative appointed by the Promoters.
6.5 Winners shall be notified using the contact details supplied during the booking process.
6.6 If a selected winner cannot be contacted after 3 (three) attempts over a 48-hour period, or fails to comply with verification requirements, the prize shall be forfeited and an alternative winner may be selected.
6.7 A participant may only win once during the Competition period unless otherwise determined by the Promoters in writing.
7. Verification Requirements
To claim the prize, the selected winner must provide the following documentation within 5 (five) business days of notification:
7.1 A valid certified copy of their South African identity document or permanent residence permit.
7.2 A recent certified bank statement or official letter from the relevant financial institution, dated within the preceding 30 (thirty) days, confirming:
• the mortgage account number;
• the monthly instalment amount; and
• the account holder details.
7.3 Proof that the bonded property is the winner’s primary residence, which may include a utility bill, municipal statement, bank correspondence, or similar proof of address dated within the preceding 3 (three) months.
7.4 Proof that the winner is legally responsible for the mortgage obligation.
7.5 The Promoters reserve the right to request any additional documentation reasonably required to verify the authenticity of the claim or the eligibility of the winner.
7.6 Failure to provide satisfactory verification documentation within the prescribed period may result in disqualification and forfeiture of the prize.
8. POPIA & Data Privacy
8.1 By entering the Competition, participants consent to the Promoters processing their personal information for purposes directly related to:
• administering the Competition;
• facilitating meeting bookings;
• conducting the draw; and
• communicating with participants regarding Competition-related matters.
8.2 Any consent to receive future marketing communications from Keveko or Black Cygnet shall be optional and subject to a separate opt-in process.
8.3 All personal information shall be processed in accordance with the provisions of the Protection of Personal Information Act 4 of 2013 (“POPIA”).
8.4 Participants may withdraw their consent to marketing communications at any time in accordance with applicable law.
8.5 Virtual meetings may be recorded for quality assurance, compliance, training, or record-keeping purposes, subject to applicable law.
9. Publicity
9.1 Winners may be requested to participate in reasonable publicity and marketing activities related to the Competition.
9.2 Participation in such publicity shall be voluntary, and winners may decline participation without prejudice.
10. Limitation of Liability
10.1 The Promoters shall not be liable for:
• any technical failures;
• network interruptions;
• booking platform errors;
• connectivity issues;
• or any circumstances beyond their reasonable control which may affect participation in the Competition.
10.2 The Promoters shall not be responsible for incomplete, lost, delayed, corrupted, or misdirected entries or communications.
10.3 To the fullest extent permitted by law, the Promoters exclude all liability for any loss, damage, or claim arising from participation in the Competition or acceptance of the prize.
11. Fraud, Abuse & Disqualification
11.1 The Promoters reserve the right to disqualify any participant suspected of fraud, dishonesty, abuse of the Competition process, manipulation of the draw, or breach of these Terms and Conditions.
11.2 Any attempt to manipulate the Competition, booking process, or verification process may result in immediate disqualification.
12. Right to Amend or Terminate
12.1 The Promoters reserve the right to amend, suspend, or terminate the Competition at any time should unforeseen circumstances, technical failures, legal requirements, or events beyond their reasonable control compromise the integrity or feasibility of the Competition.
12.2 Any amendments shall be published on the official Competition landing page.
13. Governing Law & Disputes
13.1 These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
13.2 Any dispute arising from the Competition shall first be referred to the Promoters for resolution before either party pursues any external remedy available in law.
14. General
14.1 By participating in the Competition, participants acknowledge that they have read, understood, and agreed to be bound by these Terms and Conditions.
14.2 The Promoters’ decision regarding any aspect of the Competition shall be final and binding, subject to applicable law.
